1. Limited Warranty
CODEX warrants to Customer that its new products will materially conform to their published specifications and will be free from defects in material and workmanship under normal use and service.
This Limited Warranty applies only to products purchased from CODEX or an authorised CODEX reseller.
This Limited Warranty is provided solely to the original end user purchaser and is non-transferable, except where prohibited by law. It does not extend to any subsequent owner or recipient of the product.
2. Warranty Period
The warranty period begins on the date of the original retail purchase and continues until whichever of the following occurs first:
2.1 Two (2) years from the date of purchase for products that have not been registered with CODEX.
2.2 Three (3) years from the date of purchase for products that have been successfully registered with CODEX within the applicable registration period.
2.3 The product exceeds its specified Total Bytes Written (TBW) endurance rating.
2.4 The product's reported lifespan indicator exceeds 100%.
Once any of the above conditions is met, the warranty shall automatically expire.
3. Warranty Registration
Eligible products may qualify for an extended three (3) year warranty by completing product registration through the CODEX Product Registration online form within a period not exceeding thirty (30) days from purchase.
Standard warranty of (2) years will apply if the eligible product is not registered within thirty (30) days since purchase.
CODEX reserves the right to request proof of purchase when processing any warranty claim.
4. Warranty Remedies
If CODEX determines that a product is defective and covered by this Limited Warranty, CODEX will, at its sole discretion:
4.1 Repair the defective product;
4.2 Replace the defective product with an equivalent product; or,
4.3 Where an equivalent product is unavailable, replace it with a product of equal or higher specification.
CODEX warrants to Customer that it shall perform the Services using personnel of required skill, experience, and qualifications and in a professional and workmanlike manner in accordance with generally recognised industry standards for similar services and shall devote adequate resources to meet its obligations under this Agreement.
Any repaired or replacement product will continue to be covered only for the remainder of the original warranty period. The repair or replacement does not restart or extend the original warranty period.
If CODEX determines that the product cannot reasonably be repaired or replaced, CODEX may instead refund the original purchase price paid for the product upon return of the defective product.
The remedies described in this section constitute the sole and exclusive remedies available under this Limited Warranty.
5. Exclusions
This Limited Warranty does not apply to any defect, failure or damage resulting from:
5.1 Accident, misuse, abuse, neglect or improper care;
5.2 Modification or unauthorised alteration of the product;
5.3 Improper handling, improper installation or improper operation;
5.4 Disassembly or attempted repair by anyone other than CODEX;
5.5 Operation outside the product's intended use or published specifications;
5.6 Normal wear and tear;
5.7 Removal, alteration or defacement of product labels, serial numbers or identification stickers;
5.8 Incompatibility with, or faults arising from, third-party hardware, software or accessories not supplied or approved by CODEX; or
5.9 Data recovery services performed by anyone other than CODEX.
Except for the warranties set forth in sections 1 to 4, CODEX makes no warranty whatsoever with respect to the goods or services, including any (a) warranty of merchantability; (b) warranty of fitness for a particular purpose; (c) warranty of title; or (d) warranty against infringement of intellectual property rights of a third party.
6. Data Responsiblity
Products returned under this Limited Warranty may be repaired, reformatted, replaced or otherwise processed in a manner that permanently erases stored data.
Customers are solely responsible for backing up and removing all data before returning any product for warranty service.
CODEX accepts no responsibility or liability for any data, images, video, files or other information stored on any product submitted for warranty service, nor for any loss, corruption or recovery of such data.
7. Shipping
The customer is responsible for the cost of shipping the product to CODEX for warranty assessment.
Where CODEX confirms that the product is covered by this Limited Warranty, CODEX will pay the cost of shipping the repaired or replacement product back to the customer using a shipping method of CODEX's choosing.
If CODEX determines that the warranty does not apply, the customer may be responsible for return shipping costs before the product is returned.
8. Proof of Purchase
A valid proof of the original purchase date from CODEX or an authorised CODEX reseller may be required before any warranty claim can be processed.
CODEX reserves the right to refuse warranty service where satisfactory proof of purchase cannot be provided.
9. Limitation of Liability
To the maximum extent permitted by applicable law, CODEX's liability under this Limited Warranty is limited exclusively to the cost relating to repair, replacement or refund remedies described above.
CODEX shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, loss of business, loss of revenue, loss of use, loss of goodwill, or loss of data, arising from the use of or inability to use the product, even if advised of the possibility of such damages.
CODEX shall not be liable for a breach of the warranties set forth in Sections 1 to 4 unless:
9.1 Customer gives written notice of the defective Goods, as the case may be, reasonably described, to CODEX within 30 days of the time when Customer discovers or ought to have discovered the defect;
9.2 if applicable, CODEX is given a reasonable opportunity after receiving the notice of breach of the warranty set forth in Sections 1 and 2 to examine such Goods and Customer (if requested to do so by CODEX) returns such Goods to CODEX's place of business for the examination to take place there; and
9.3 CODEX reasonably verifies Customer's claim that the Goods are defective.
CODEX shall not be liable for a breach of the warranty set forth in Sections 1 to 4 if:
9.4 Customer makes any further use of such Goods after giving such notice;
9.5 The defect arises because Customer failed to follow CODEX’s oral or written instructions as to the storage, installation, commissioning, use or maintenance of the Goods; or
9.6 Customer alters or repairs such Goods without the prior written consent of CODEX.
